Court finds Ranked-Choice Voting Act Unconstitutional

AUGUSTA – Tuesday, at the request of the Maine Senate, the Maine Supreme Judicial court issued an advisory opinion to invoke a ‘solemn occasion’ and issued an informational opinion on the constitutionality of ranked-choice voting. The seven justices of the court unanimously ruled that the Ranked-choice Voting Act conflicted with the constitution.

Speaker of the House Sara Gideon issued the following statement:
“As a supporter of ranked-choice voting, I personally find this decision disappointing. However, I respect the opinion issued from the court and it is our primary duty as legislators to uphold the constitution. I will work with my colleagues in the Legislature to address the issues the court has identified. It is imperative that we move quickly in order to remove any uncertainty in our electoral process.”
